  5. Preamble

  8. The intent and purpose of this license is to provide a way to
  9. distribute software and other copyrighted material for free 
  10. and to ensure that the same rights provided by this license 
  11. are passed on perpetually with any and all copies of the 
  12. individual work or package that this license covers.

  14. It is also the intent of this license to allow changes to be 
  15. made to the individual works or package providing that those 
  16. changes are in harmony with the original intent and purpose

  39. “Reasonable copying fee” is what you can justify on the basis 
  40. of media costs, duplication costs, time of people involved, and 
  41. delivery costs.  These costs must be in line with standard industry 
  42. practices and not padded for the purposes of making money.

  44. “Freely Available” means that no fee is charged for the item 
  45. itself, though there may be a reasonable copying fee.  It also 
  46. means that recipients of the item may redistribute it under the 
  47. terms and conditions of this license.

  81. 3) Any commercial use must have express written permission 
  82. from the copyright owner.  Commercial use includes (but is not 
  83. limited to):

  85.   a) Any special area for which there is a subscription fee or
  86.      service charge in addition the standard fee, of any
  87.      commercial electronic forum (e.g. AOL, CompuServe,
  88.      Prodigy, bulletin boards.)
  89.   b) Any commercial media including but not limited to 
  90.      commercial software releases, software bundles, etc.
  91.   c) Any promotional materials (free CD in magazine, etc.)
  92.   d) Electronic forums not falling under 3a are not to be
  93.      considered commercial use.  As such, use on these forums
  94.      falls under the terms for non-commercial use (above).

  96. 4) No additional cost is to be added to the commercial 
  97. distribution for the inclusion of the TopSoft software.
  98.  
  99. 5) The TopSoft software and/or TopSoft name may not be used in 
  100. any promotional material (including external packaging of the 
  101. commercial product) other than to give credit as in paragraph 6.

  104. General provisions:
  105. ------------------

  107. 6) The copyright holder of the work is given credit and that credit 
  108. displayed with other credits and copyright notices displayed by 
  109. the work.
  110.  
  111. 7) The scripts and library files supplied as input to or 
  112. produced as output from the programs of this Package do not 
  113. automatically fall under the copyright of this Package, but 
  114. belong to whomever generated them.

  116. 8) Source code subroutines supplied by you and linked into 
  117. this Package shall not be considered part of this Package, 
  118. but are the equivalent of input as in Paragraph 7.

  120. 9) The terms and conditions of this specific version of this 
  121. license may not be modified or added to.

  123. 10) This license provides no warranty either expressed or 
  124. implied for this package or any individual work distributed 
  125. under this license.  Any warranty or disclaimer of warranty 
  126. covering this individual work or package must be in included 
  127. as a separate document specifically labeled as such.

  129. 11) In the event that the terms of this license are violated, 
  130. the use of works covered by this license must be terminated.

  132. 12) In the event that any clause of this license is found not 
  133. to be supportable by law, that clause shall be considered void 
  134. and all other clauses of this license are to remain intact.
